In German legal doctrine, the issue of the order of admissibility and justiciability requirements in civil proceedings has not yet been definitively resolved. This paper attempts to propose a new solution to this still open question. The proposed solution is based on a distinction between absolute and relative admissibility requirements: the absolute admissibility requirements are conditions for any substantive decision and therefore deserve a priority examination. The relative admissibility requirements serve a protective function in favor of one of the parties and are only conditions for a favorable or unfavorable substantive decision, depending on whether they protect the interests of the defendant or the plaintiff.
