The third-party protection of a norm is significant in various areas of the legal system. It is a prerequisite for a subjective public right. Furthermore, a claim based on official liability requires the violation of a third-party related official duty, which in turn depends on the third-party protection of the violated norm. This work explores the significance and prerequisites of third-party protection of norms and then addresses the third-party protection of norms related to banking and insurance supervision, general municipal supervision, and the oversight of the European Commission over the member states. Special attention is given to liability due to improper exercise of municipal supervision in the case of the Saxon municipality of Oderwitz and to liability due to improper exercise of banking supervision in the case of the BVH.
