The development of electronic communication is one of the biggest changes in recent years. E-commerce is showing significantly increasing sales figures. Accordingly, the use of electronic documents as evidence in civil proceedings is becoming increasingly important. The legislator has introduced new regulations in the German Civil Code (BGB) and the Code of Civil Procedure (ZPO) regarding this matter. This presentation critically examines these changes and demonstrates that electronic documents must rightly be understood as certificates.
