The protection of church buildings from expropriation is the subject of this investigation, which is based on the church property guarantee enshrined in Article 140 of the Basic Law in conjunction with Article 138, paragraph 2 of the Weimar Constitution. The Basic Law does not contain its own ecclesiastical legal provisions but incorporates those of the Weimar Constitution. Therefore, this study not only highlights the protective content of Article 138, paragraph 2 of the Weimar Constitution within the changed constitutional framework but also examines its relationship to the property guarantee in Article 14 of the Basic Law. Additionally, historical constitutional backgrounds and the differing opinions in jurisprudence and literature are discussed. Finally, the foundations for expropriation and the procedures for compensation are outlined.
