The work deals with the emergency tasks that must be carried out during a strike, ensuring that the existence of the striking companies is not jeopardized and that third parties are not unduly affected. Through emergency tasks, it is possible to influence the pressure effect of a strike and thus the substantive fairness of collective bargaining negotiations. It is all the more important to carefully consider the various approaches to deriving the obligation of social partners to perform emergency tasks and to outline the legal framework within which employers, unions, or both together are entitled to engage employees, whose duty to work is suspended due to participation in the strike, to perform emergency tasks.
