Corporate restructuring often leads to new operational conditions. The topic associated with collective labor law examines the effects such changes have on the overall works council and overall works agreements. Individual aspects of this were the subject of decisions by the Federal Labor Court on June 5, 2002, and September 18, 2002. The work analyzes these approaches and presents practical solutions for the categories of internal and cross-company restructuring through a dogmatic methodology. Taking into account new developments in jurisprudence and literature, it particularly clarifies the significance of the so-called operational identity and the question of the connection between the overall works council and the company for both areas.
