The legal power of representation has always been in a tension between care and disenfranchisement. According to the values of the Basic Law, which prioritizes private autonomy and self-responsible life design, a legal power of representation is only justified when there is a corresponding need for assistance, as in the case of children or sick or disabled individuals. Therefore, the existing legal rights of representation to extend such powers to close relatives for adults face significant concerns regarding their constitutionality. The challenge lies in finding a balance between the conflicting interests of protecting privacy from external interference and safeguarding the vulnerable from the abusive exercise of representative power. In light of this, the question arises as to whether such a far-reaching regulation, which deeply interferes with family law relationships, is constitutionally permissible, makes sense from a legal policy perspective, and, as claimed, aligns with the will of the population.
