This book examines the insider trading prohibition in hedging transactions. In recent years, the legislator has extensively reformed both market abuse law and the legal framework for hedging transactions. After presenting the economic fundamentals of hedging, the author analyzes the possibilities of rebutting the presumption of use of insider information in hedging transactions through the newly established legitimate actions and previously recognized categories. With regard to the purpose and intent of the insider trading prohibition and insights from Behavioral Finance, she discusses the possibility of an unwritten hedging exception. Additionally, she sheds light on insider law issues related to specific hedging strategies.
