Product details
The International Antitrust Private Law was standardized across the EU in 2009 through the Rome II Regulation. With Article 6(3) of the Rome II Regulation, there is now a specific conflict-of-law rule for claims arising from competition restrictions. This work addresses the innovations that the connection of antitrust private law claims under the Rome II Regulation entails. The questions discussed include the temporal scope of the regulation, the relationship to the Rome I Regulation concerning claims resulting from a void contract, and the special provision of Article 6(3)(b) of the Rome II Regulation for multi-state violations. The work concludes that the provisions of the Rome II Regulation represent a meaningful tool for promoting the private enforcement of competition law.
