"Church asylum" refers to the increasing cases over the past 15 years of churches providing shelter for refugees to protect them from state deportation. The study examines the development of this phenomenon in its first empirical part. It investigates the motives of the parties involved, both from the church and the state, as well as their mutual reactions when granting church asylum. Special attention is given to the complex internal church discussions. The second legal part explores the statutory and constitutional implications of church asylum. The author seeks a legal solution primarily in the fundamental right to freedom of belief and conscience. His findings could offer both the state and the church a framework for resolving this social and political conflict.
