The continuous efforts of coastal states to further expand their competencies and responsibilities clash with the fundamental principle of freedom of the seas. The issuance of maritime spatial planning plans for the North and Baltic Seas in 2009, which aim to regulate the increasing uses of the sea, also conflicts with the principle of freedom of the seas. The goal of this work is to analyze the spatial overall planning carried out by the issuance of the maritime spatial planning plans in the Exclusive Economic Zone (EEZ) with regard to its legal permissibility. In this context, particular emphasis will be placed on examining § 17 para. 3 of the Spatial Planning Act (ROG), which underlies the maritime spatial planning plans, for its conformity with constitutional and international law. This will be followed by an investigation into the international legal permissibility of the spatial planning plans for the North and Baltic Seas.
