In recent years, amidst efforts for administrative modernization and the reform of administrative jurisdiction, the topic of mediation in the public sector has increasingly come to the forefront of interest for both academia and practice. However, the discussion suffers from a certain narrowness, as largely only the positive aspects of this method of conflict resolution are emphasized. The volume presented here significantly broadens these reference lines. The contributions gathered in it, on one hand, examine the effectiveness of mediation in relation to other instruments of dispute avoidance or resolution within the framework of administrative action and its functional connection to the administrative process. On the other hand, they assess its impact in administrative and social jurisdiction as well as the constitutional conditions that mediation is subject to when applied in administrative procedures and processes. As a result, it becomes evident that the legislative redesign of a public law dispute avoidance and resolution procedure through mediation would currently be premature.
