The European Union has evolved from a purely economic union into a political entity, primarily due to expansions in primary law and the adoption of its own Charter of Fundamental Rights. With the entry into force of the Lisbon Treaty, which aims to advance European integration and establishes the Charter of Fundamental Rights as binding law, this development will continue to progress. In this context, the work addresses the question of whether the European approach to broadcasting meets the changing structures of the European Union. It examines the functions that broadcasting—primarily public broadcasting according to the dual structure in the member states—fulfills in Europe and what functions it should fulfill. To this end, the dual broadcasting regulations in Germany and all other member states of the European Union are analyzed. Specific broadcasting-related legal acts and broadcasting policy activities at the European level are reviewed to determine whether they meet the requirements of a pluralistic broadcasting system. Conclusions are drawn from the constitutions of the member states as well as from the case law of the European Court of Human Rights and the Court of Justice of the European Union regarding freedom of expression under Article 10 of the European Convention on Human Rights and the provisions of Article 11(2) of the Charter of Fundamental Rights, leading to a European understanding of freedom of expression and media. The results of the investigations suggest that at the European level, at least the framework conditions of a dual broadcasting system characterized by pluralism should be established— for example, through the creation of a dedicated broadcasting article.
