The legal treatment of product placements in Germany changed with the enactment of the 13th Amendment to the State Treaty on Broadcasting on April 1, 2010. Since then, product placements are permitted in legally specified exceptional cases. The State Treaty on Broadcasting, as amended by the 13th Amendment, regulates the permissibility of product placements in public broadcasting on one hand and in private broadcasting on the other hand with differing levels of strictness. This work examines this disparity in requirements against the backdrop of the dual broadcasting system and demonstrates that the regulatory imbalance in broadcasting law is ultimately justified at the expense of public broadcasting.
