The book deals with the legal restrictions on assemblies that appear intimidating solely based on their outward appearance, such as skinhead marches and the Black Bloc. Relying on bans on uniforms, bans on face coverings, bans on militancy, or the general clause of § 15 I of the Assembly Act, assembly authorities prohibit certain intimidating forms of assembly. However, these modalities are protected by the freedom of assembly and are not classified as unpeaceful in the sense of Art. 8 I of the Basic Law. The norms of the Federal Assembly Act and those of the Free State of Bavaria, which aim to counteract intimidating forms of assembly, restrict the freedom of assembly in an unconstitutional manner or are applied by the assembly authorities in an unconstitutional way.
