The author examines the legal consequences associated with the choice of a legal form of public administration. He considers the legal advantages and disadvantages that depend on the selection of a specific legal form, such as that of an institution, foundation, or limited liability company (GmbH). In the literature, doubts have repeatedly been raised that more or less clearly question the distinctiveness of the legal forms of public administration. These doubts serve as the basis for a systematic and comparative investigation of the legal forms of public administration, resulting in a clear deconstruction of these legal forms.
