The author examines the legal boundaries of extraterritorial retail regulation using selected regional retail concepts as examples. Different forms of retail concepts are taken into account. Legal boundaries can be derived from both EU law and constitutional law, as well as from ordinary law. They are significant, among other things, for the question of which regulations regarding large-scale retail may be established at the regional level and which are reserved for municipal land-use planning. This tension between spatial planning and the constitutionally guaranteed self-administration rights of municipalities under Article 28, Paragraph 2 of the Basic Law is a focal point of the investigation.
