Arbitration as an alternative form of dispute resolution is particularly recognized in contracts with an international context. Arbitration proceedings not only provide a high degree of party autonomy but also the special expertise of arbitrators, the exclusion of the public, and straightforward enforcement abroad. Since arbitral tribunals exercise substantive jurisdiction, arbitrators must adhere to the principle of impartial justice. This requires the independence and neutrality of the individuals appointed to make decisions. The work examines the legal framework to ensure these conditions under German and English law, taking into account the guidelines of the International Bar Association.
