Today, there is really no need to say much about consumer protection as a normative objective, as many laws for the protection of consumers have been enacted in Germany, primarily initiated by EU law. Nevertheless, there is every reason at this time to reaffirm the legitimacy of consumer protection and the foundational legislative concepts. This work therefore addresses central fundamental questions of consumer protection law: The foundations of civil law, private autonomy, and specifically contractual freedom are increasingly compromised by a growing protection of the perceived weaker contracting party. The primary concern of the study is to counteract a blind and undifferentiated adoption of social protection ideas into general contract law.
