The work examines the legal aspects of art purchases by private individuals. To contextualize the figure of the 'art consumer', the foundations of consumer protection law are first outlined. This is followed by a presentation of the actors involved in the art market and an analysis of the artwork as an object of law. Building on this, the work details the liability for defects when purchasing art objects and the specific characteristics that arise from it. This leads to a catalog of conceivable defects in art purchases and the establishment of an art market-specific standard of care. The work then addresses liability exclusions and potential grounds for invalidity, particularly in consumer transactions. The investigation concludes with the determination of international jurisdiction and applicable law in international, cross-border art purchases.
