Product details
This work addresses whether a merger of administrative and social jurisdiction is possible and advisable. To this end, it presents three central models. The Speyer draft and the subsequent administrative procedural code are also taken into account. The constitutional and European legal framework of these reform proposals is examined. The administrative procedural code and the social court law are analyzed for differences and similarities. The work concludes that the similarities between the procedural codes prevail. This is further reinforced by recent legislative amendments. The author proposes a nationwide, institutional merger of social and administrative jurisdiction and a return to the unifying, general dogmatics of the administrative procedural code and the administrative procedure law.
