Principles of connecting factors in European conflict-of-law rules
German, AnjaSophia, Schwemmer, 2018Product details
The unified European conflict of laws employs the classical conflict-of-laws technique of comprehensive reference norms. However, new emphases are placed on the choice of connecting factors. Not all of the new connections can be represented as concretizations of Savigny's principle of closest connection. Against this background, Anja Sophia Schwemmer examines the connecting principles of European conflict of laws, taking into account primary law valuation criteria. In doing so, she specifically addresses the question of the extent to which the Union legislator still adheres to the classical principle of closest connection and the neutrality paradigm when choosing connecting moments, and to what extent these are overshadowed or even displaced by integration policy objectives.
