Recent cases of food recalls have highlighted the seriousness of defective food products - the health risks to consumers as well as the negative financial and reputational consequences for food manufacturing companies. In the course of harmonizing food monitoring in Europe and implementing EU directives into national laws or regulations, existing laws have been supplemented. According to the product liability law enacted in Germany in 1990, manufacturers are liable for food products they place on the market, even if no culpable behavior can be proven. On the other hand, tort liability is already regulated by §823 of the German Civil Code (BGB). The complex legal situation and its consequences for the food industry, such as risk mitigation or easing the burden of proof, are presented in an easily understandable manner in the book.
