While in some member states of the European Union the organization of gambling on a larger scale is carried out by private companies, gambling law in the Federal Republic of Germany, as in most member states, is still characterized by a public-law monopoly situation. Given the ongoing expansion and increased attractiveness of state gambling offerings, as well as the Europeanization and internationalization of the entire gambling market, the question arises whether this monopoly situation can still withstand constitutional and community law scrutiny. The authors of this study examine this question using the example of sports betting, which, in the form of the Oddset bet, has recently been offered alongside the traditional football penalty bet (so-called football Toto) with great success by the state-owned Toto-Lotto companies.
