After the rulings of the European Court of Justice in the cases of Schulte and Crailsheimer Volksbank in 2005, many small investors breathed a sigh of relief: The court decided that a bank must bear the consequences of the risks associated with the financed capital investment if it failed to inform about the right of withdrawal. Many borrowers associated this European consumer protection guideline with the hope of being released from the liabilities of the failed investment. But how can the content of the European rulings be implemented in German law? This paper deals with the exercise of the right of withdrawal and the assertion of claims for damages, while also addressing issues related to statutes of limitations.
