Product details

The protection of a party perceived as weaker has gained importance in international private law over the past few decades. Consequently, in nearly all international regulations, consumers and employees primarily benefit from special conflict-of-law provisions.

This issue is addressed in the book concerning European conflict of laws. Both the Rome I Regulation and the Rome II Regulation provide specific provisions for the protection of a party perceived as weaker. The author demonstrates, with regard to the relevant provisions, that the "weaker" party is protected by the European legislator in very different ways across various contexts. She therefore explores whether there is a conflict-of-law valid reason for the choice of different regulatory models.
