In legal discourse, since the paradigm shift from morality to the protection of legal goods, the dogma of a state-free private sphere has been propagated, which some consider the epitome of modern statehood. However, there are indeed various legal regulations regarding consensual sexualities that relate to autonomy, privacy, protection from confrontation, population policies, immigration, public service, youth protection, commercialization, or moral concepts. The authors of this volume question the necessity, legitimacy, design, and limits of regulations concerning consensual sexuality as a significant social practice of citizens, which touches on state interests, concerns successful coexistence, and stands in competition with and interdependence to other, particularly gender-related, normative orders.
