In Germany, the number of alternative dispute resolution procedures, such as arbitration or mediation, is increasing for various reasons. Unfortunately, the number of corporate and consumer insolvencies is also rising. This work addresses the questions that arise from the intersection of these different procedures. The first part of this work examines the issues that arise due to the insolvency administrator's obligation to adhere to a pre-insolvency arbitration agreement of the debtor after the insolvency proceedings have commenced. The second part of the work deals with the possibilities of conducting mediation procedures or applying individual mediation techniques during the insolvency proceedings.
