Abstract: This paper examines the possibilities available to individuals under statutory guardianship to implement their own wishes and life plans. At the same time, it highlights the limitations that arise, the legitimacy of which is explained and questioned through various approaches. The first part of the paper focuses on the image of individuals under guardianship and the definition of self-determination. Additionally, the fundamental right to self-determination that exists for every citizen is presented along with the relevant legal foundations. This chapter is concluded with an exploration of the extent to which individuals with intellectual or mental impairments are affected.
