Abstract: This thesis deals with sexual harassment in the workplace, focusing particularly on the employer's options for action as follow-up responses. As an introduction to the topic, it first examines what is meant by sexual harassment at work and how the law defines the term. It is essential to explore the differentiated harassment constellations and their legal backgrounds in the subsequent sections.
Next, the possible effects and legal consequences of sexual harassment are explained in detail. Three perspectives are distinguished here: first, the claims that the victim has against the employer; second, the potential legal relationships that could arise between the employer and the perpetrator; and third, the implications for the company itself. The various forms of sanctions and their prerequisites are also of particular interest. In the following section, various court rulings that focus on sexual harassment in the workplace are analyzed, with special attention given to the different starting situations and the reactions of the respective employers.
The main focus of this thesis is a general action plan as a decision-making aid for the employer when sexual harassment in the workplace has actually occurred. Not every disadvantage constitutes sexual harassment, and not every case of sexual harassment can be immediately addressed with termination. Finally, the analyzed results should be viewed in light of the question of what course of action an employer should take in the previously highlighted harassment constellations.
