The work deals with consent to medical treatment for minors. The topic of consent to medical interventions and the conditions for its validity is a central issue in medical law. The questions surrounding consent are particularly relevant when the patients are children and adolescents. This is an area that is not regulated by German law, leading to a variety of differing legal opinions. The study also includes a comparative analysis of Austrian and Swiss law. Due to the lack of statutory regulation and the inconsistent case law, there is a significant degree of legal uncertainty in Germany. At the same time, case law and literature in the field of civil law are at risk of becoming inconsistent.
