The targeted allocation of public contracts in the European Union is the subject of this work. After examining the practices of the member states, the relevant EU directives are analyzed. It becomes clear that the harmonization of procurement through the procurement directives in this area is not conclusive. For this reason, reference is made to the EU Treaty. While it prohibits any direct or indirect connection to the nationality of the participant, it fundamentally allows non-discriminatory procurement practices without trade-restrictive effects. Overall, regional political secondary purposes appear to be impermissible, while in other cases, the legal technical approach is crucial. The formulation of transparent criteria for a specific procurement procedure is legally preferable to referencing domestically prevalent standards.
