Since the financial market crisis, special purpose vehicles from securitization platforms have entered public consciousness. Several credit institutions found themselves in distress as off-balance-sheet securitization vehicles heavily burdened the involved banks. In light of the financial crisis, the International Accounting Standards Board (IASB) published new consolidation rules. Andreas D. Christ examines the new IFRS regulations as applied to complex securitization structures. The analysis is based on a cross-standard consideration of "control" as the decisive criterion for delineating the consolidation scope. Additionally, the author draws comparisons to the old law and clarifies the shortcomings of the new regulations, to which he proposes an alternative solution.
