Our civil procedure law has developed vigorously since the war. From the very beginning, the Federal Court of Justice has adopted a refreshingly progressive stance and corrected some of the overly rigid statements of the Reichsgericht. Moreover, the science of procedural law has also experienced a promising upturn. Valuable individual studies have made the paths opened by the teachings of the 1920s largely accessible; without arrogance, it can be stated that our doctrine of the dogmatics of civil law is catching up in large strides and is on the verge of overcoming its methodological lead. Presenting what has been achieved in theory and practice is the task of my book. In doing so, I have endeavored to eliminate the still encountered conceptual legal or literal arguments from the discussion and replace them with substantive reasons.
