The aim of this study is to analyze the historical developments of constitutional jurisdiction, norm control, and the protection of fundamental rights in Germany. Where is the boundary to constitutional jurisdiction? How can the selection of judges and the composition of the senates influence their independence? Furthermore, the future perspectives of constitutional jurisdiction for China are examined. The development of the Chinese constitution, the state structure, and the protection of fundamental rights highlight the necessity of establishing a constitutional jurisdiction in China. Finally, the discussion will focus on which model of constitutional jurisdiction is suitable for the Chinese constitution.
