The Private Foundation Act (PSG) contains only a few explicit provisions regarding the rights of beneficiaries and does not include any regulations that declare the granting of additional rights to beneficiaries in the foundation declaration as impermissible. In accordance with the principle of freedom of contract, the founder is therefore able to grant beneficiaries additional rights in the foundation declaration that go beyond the legal scope. The present work 'Founder's Intent and Beneficiary Rights' addresses the question of which rights can be granted to beneficiaries by the founder and to what extent. Problems arise when beneficiaries receive rights that grant them an owner-like status, which is incompatible with the private foundation as an ownerless legal entity.
