This dissertation presents the property security from its origins in Roman law to the current legal systems of Austria and Germany. It spans from the Twelve Tables legislation to the German Risk Limitation Act of August 12, 2008. After discussing the mortgage, which exists exclusively in Austria, and its various forms, there follows a treatise on the German mortgage in its different manifestations and on the land charge. The work concludes with a comparison of all the mentioned institutions and suggestions for a possible harmonization of Austrian and German property law.
