With the opening of the insolvency proceedings, the insolvency administrator is assigned a variety of tasks. The determination of the assets is a very important point in this process. As part of this assessment, the insolvency administrator must, in accordance with § 96 para. 1 of the Insolvency Act, immediately prepare an inventory. The preparation of the inventory is usually associated with an estimation. For estimates that present particular difficulties, the insolvency administrator may, under certain conditions, also utilize the expertise of third parties, for example, when estimating real estate. The Insolvency Act refers to the provisions of the Enforcement Act, which in turn refers to the Real Estate Valuation Act. The aim of this work is to illustrate the estimation of real estate. To this end, the relevant legal provisions of the Insolvency Act, the Enforcement Act, and the Real Estate Valuation Act will be discussed.
