The factoring market is an emerging part of corporate financing in Austria. Significant volume increases raised the total factoring volume in 2008 to over 6 billion euros. The civil law, insolvency law, and especially the avoidance law treatment of factoring contracts play a crucial role in the contractual design of factoring. The book first analyzes the civil law elements of factoring, particularly the question of whether it is structured as a sales or credit transaction. After a thorough discussion of the consequences of the opening of insolvency proceedings over the assets of the factoring client for the factoring contract and individual factoring transactions, the second half of the book delves into the avoidance law options in detail.
