The public sector can essentially achieve its goals in two ways: on one hand, through the application of sovereign command and coercive power ("Imperium"), and on the other hand, through the conclusion of contracts. In the first case, this is referred to as sovereign administration, while in the second case, it is called private economic administration. While the state acting in a sovereign capacity is subject to the strict principle of legality according to Article 18, Paragraph 1 of the Federal Constitutional Law (B-VG), for the state operating in a private capacity, only those legal provisions that also govern the legal relationships between private individuals generally apply, particularly the provisions of the General Civil Code (ABGB).
