In times of increasing mobility, cross-border relationships between individuals of different nationalities are no longer uncommon. The EU acknowledges the growing internationalization of relationships and offers its citizens, in accordance with Article 3(2) TEU, a space of freedom, security, and justice (FSJ). Fundamental to this FSJ are the principles of mutual recognition and mutual trust. The Pove case—a case of child abduction—illustrates that these two principles still pose challenges in practice. The case involved not only the Austrian courts but also the CJEU and the ECtHR. The CJEU was initially faced with several questions regarding the application and interpretation of the Brussels IIa Regulation. The ECtHR was approached by both the abducting mother and the father regarding violations.
