Product details
Default judgments are necessary to ensure swift and efficient proceedings. Through a system of statutory consequences for default, the legislator imposes limits on the inactive party. However, default judgments often contradict the material truth, as they create formal law regardless of the actual circumstances. This creates a clear tension between procedural concentration or process economy and formal default decisions. The challengeability of default judgments is therefore of practical interest. The aim of this work is to address the individual legal remedies within their respective closed systems, as well as the relationship between these remedies and their options for selection or cumulation.
