The sampling of music sequences is currently viewed less as a musical process and more as a new, independent art form. Although these musical forms have developed into influential genres within the music industry, their legal classification is not always clear-cut. This book examines the legal categorization of the sampling process under Austrian copyright law. The author investigates which rights may be infringed upon when a sound sequence is taken and subsequently used in a new work. Since not only the author but also the performer with related rights and the phonogram producer may have their rights affected, all parties involved are closely analyzed. The landmark ruling "Metall auf Metall II" by the Federal Court of Justice in Germany is also discussed.
