The so-called "Means Test" was introduced by the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) in 2005, with the aim of preventing cases of abuse that may arise in connection with a bankruptcy filing under "Chapter 7" (liquidation). Essentially, the "Means Test" is a complex legally mandated measure designed to establish a presumption of abuse. This occurs when it is determined that the debtor could pay a portion of their unsecured debts in the future. To assess this, the debtor's available income must be calculated through a precisely defined accounting process. If the presumption of abuse arises, the debtor is not allowed to utilize the typically more favorable "Chapter 7" procedure.
