European and German legislation increasingly relies on new forms and instruments of behavioral regulation in the field of environmental law to achieve desired environmental goals. Often, multiple regulations are applied alongside or simultaneously. As a result of the combination and accumulation of different instruments, there can be a summation of freedom-restricting effects, which is inadequately addressed by the current fundamental rights doctrine. Against this backdrop, Eun-Kyung Lee examines the existing approaches in literature and jurisprudence and develops her own model for assessing the overall proportionality of cumulative measures. She uses the energy and environmental law, particularly characterized by experimental legislation, as a reference area for her developed approach.
