Prostitution was also illegal in Austria for a long time. This changed with the repeal of the 5th Vagrancy Act in 1885 and the subsequent Criminal Law Adjustment Act of 1974. As a result, the federal states enacted their own laws regulating prostitution. Vorarlberg established corresponding regulations in Section 3 of the Vorarlberg Police Regulations. This stipulates that prostitution is only permitted in government-approved brothels. However, to this day, not a single brothel license has been granted. For several years now, a license applicant has been seeking a brothel license in Hohenems. He has so far been denied this, as the authorities have consistently ruled that the conditions of the 5th Vorarlberg Police Regulations are not met. Based on this case and the related jurisprudence of the Constitutional Court and Administrative Court, the present book analyzes the constitutionality.
