The German reunification and the accompanying budgetary problems have prompted a reconsideration of privatizations, particularly in the cost-intensive area of highway construction. The expansion of transportation infrastructure is seen as a crucial factor in achieving equal living conditions in the Federal Republic. Following the classification of highway construction as a state task, the author outlines the possible limits for privatizations in the various phases of highway construction. Initially, the classic approaches are presented. This is followed by an examination of budgetary constitutional law and the law of federal order in relation to highway construction. Subsequently, constitutional limits for privatizations are discussed. The currently debated privatization models are also presented.
