The construction industry, with a current construction volume of 255 billion euros, is one of the largest manufacturing sectors in Germany. As an industry that is extremely dependent on the overall economic development, it requires particularly reliable and attractive framework conditions in Germany. Fair and balanced contract terms are an essential component in this regard. Unfortunately, the reality is quite different in this respect. Unilaterally pre-formulated contracts that are intended to serve as the basis for numerous contractual agreements dominate the construction contract landscape. The sheer number of contractual conditions encountered that do not comply with the provisions of the General Terms and Conditions law (Sections 305 ff. of the Civil Code) is alarming. Often, it is only after years of court proceedings that a decision is made on whether a lawsuit is valid.
