Fundamental rights empower citizens and bind the state, particularly the legislator. But what applies when the citizen themselves enacts laws? Are they then entitled to fundamental rights as a (legislating) citizen or bound by fundamental rights as a (state) legislator? The tension between the concepts of the legislating citizen and the civic legislator lies at the heart of constitutional law, as it pertains to both fundamental rights and the law of state organization.
