The constitution of a state is one of the prerequisites for the functioning of its order. After the collapse of the Nazi dictatorship, those who contemplated the future organization of the German state were convinced that one of the causes for the dissolution of the Weimar Republic (Karl Dietrich Bracher) lay in the design flaws of the Weimar Constitution. To avoid these, the consultation and adoption of the Basic Law provided an opportunity for an initially West German state. Initially, the emergence of partial orders on German soil had to be anticipated, given the growing divergences between the Western Allied powers and the Soviet occupying force. The framers of the Basic Law sought to design the interplay of state organs in such a way as to facilitate the exercise of power.
